1. About Serverspot

Serverspot may help you deploy Laravel, Node.js, Python, PHP, static, Docker, and other supported applications to servers you connect or to Serverspot-managed hosted app infrastructure, depending on the feature and plan you use.
2. Eligibility and Accounts

You agree to:
- Provide accurate and current account, billing, and workspace information.

- Use strong access controls and grant team permissions only to people who need them.
- Notify us promptly if you suspect unauthorized access or misuse.
- Accept responsibility for activity under your account, workspace, API tokens, connected providers, and invited team members.
3. Acceptable Use
You may use Serverspot only for lawful purposes and only with infrastructure, repositories, accounts, and data you are authorized to access. You must not use Serverspot to:
- Deploy, host, transmit, or operate malware, ransomware, botnets, unauthorized cryptocurrency miners, credential theft tools, phishing pages, or other malicious software.
- Conduct or facilitate denial-of-service attacks, port scanning without authorization, intrusion attempts, spam, abuse, fraud, or unlawful surveillance.
- Access, control, test, monitor, or deploy to any server, repository, network, or account without proper authorization.
- Store, distribute, or promote illegal content, child sexual abuse material, pirated software, infringing content, or content that violates the rights of others.

We may investigate suspected violations and may restrict, suspend, or terminate access where needed to protect Serverspot, users, third parties, or the public.
4. Your Servers, Apps, and Data
Serverspot is a control plane and tooling layer. You keep ownership of your code, application content, server data, and customer data. You also remain responsible for the systems and data you connect to Serverspot.
You are responsible for:
- Server hardening, firewall rules, OS updates, package updates, access control, backups, disaster recovery, and incident response.
- Ensuring that server credentials, private keys, encryption passphrases, GitHub tokens, app secrets, domains, and environment variables are accurate and authorized.
- Validating commands, deployment scripts, AI suggestions, monitoring setup, connector setup, and changes before applying them.
- Complying with privacy, data protection, consumer, employment, intellectual property, export control, financial, and industry-specific laws that apply to your apps and users.
- Obtaining any required consents from customers, employees, contractors, or users whose data is processed through your apps, logs, servers, or hosted services.
Serverspot can help you operate infrastructure, but it cannot guarantee that your servers, code, deployment choices, third-party providers, or customer data are secure, compliant, backed up, or error-free.
5. Hosted Apps, Deployments, and Integrations
Hosted apps and deployments
When you deploy through Serverspot, you authorize us to process the repository, ZIP file, deployment settings, build output, logs, generated domains, runtime configuration, and environment variables needed to build, deploy, operate, monitor, and bill for the app.
You are responsible for the lawfulness, quality, security, licensing, and performance of the code and content you deploy. We may pause, remove, or limit deployments that create security, legal, performance, abuse, billing, or platform-risk concerns.
GitHub, Google, Paystack, and other providers
If you connect third-party services, you authorize Serverspot to use them for the purposes you select, such as authentication, repository access, deployments, payments, or support. Third-party services are governed by their own terms and privacy policies. We are not responsible for their independent acts, outages, pricing, policies, or data practices.
Serverspot AI
Serverspot AI is an assistant for Serverspot-related workflows, such as creating servers, deploying apps, setting up monitoring, billing guidance, and troubleshooting. AI responses may be incomplete or wrong. Review AI-generated suggestions, command guidance, summaries, and workflow decisions before relying on them.
6. Team Collaboration
Workspace owners and server owners can invite team members and assign roles. You are responsible for choosing appropriate permissions, removing access when it is no longer needed, and monitoring activity by users you invite. Team members agree to these Terms by accepting an invitation or using Serverspot.
7. Plans, Billing, Wallet Credits, and Refunds
Serverspot may offer free, trial, paid, usage-based, wallet-funded, and contact-sales plans. Plan features, limits, prices, usage credits, and overage rates are described in the product or on the Pricing page.
- Payments: Payments are processed by Paystack. By starting a paid plan, wallet top-up, or paid usage flow, you authorize the applicable charge and any recurring or usage-based billing shown to you.
- Wallet credits and overages: Hosted app usage may consume included credits first and then deduct overages from wallet credits or create an unpaid balance for collection, depending on the plan and billing flow.
- Taxes: Prices may exclude taxes, levies, duties, or similar charges unless stated otherwise. You are responsible for applicable taxes.
- Cancellation: You may cancel a subscription from the billing area where available. Cancellation generally takes effect at the end of the current billing period unless the product states otherwise.
- Refunds: Fees are generally non-refundable except where required by law or where we determine, in our discretion, that a refund is appropriate. If you believe a charge is wrong, contact us within 14 days.
- Plan changes: We may change plan prices, limits, or features. We will provide reasonable notice for material changes affecting existing paid customers where required.
8. Intellectual Property
Serverspot, including its interface, software, workflows, documentation, brand, logo, and platform content, is owned by MergedTech or its licensors. These Terms do not transfer ownership of Serverspot to you. You receive a limited, revocable, non-exclusive, non-transferable right to use Serverspot as allowed by these Terms.
You retain ownership of your code, content, application data, server data, and other materials you provide. You grant us the rights needed to host, process, transmit, display, deploy, monitor, troubleshoot, secure, and support that material as part of Serverspot.
9. Security, Availability, and Support
We work to keep Serverspot reliable and secure, but we do not guarantee uninterrupted service, error-free operation, permanent availability of any feature, or successful deployment or monitoring of every server or app.
Availability may be affected by your servers, code, domains, DNS, credentials, network, private connectors, GitHub, Google, Paystack, AI providers, cloud providers, internet routes, maintenance, security events, or other factors outside our control.
We may perform maintenance, modify features, limit resource usage, rate-limit requests, or take emergency action where needed for security, reliability, billing, legal compliance, or abuse prevention.
10. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, Serverspot is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, security incidents on your systems, deployment failures, or loss of goodwill.
To the maximum extent permitted by law, our total aggregate liability for claims arising from or relating to Serverspot or these Terms will not exceed the amount you paid to us for Serverspot in the 12 months before the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless MergedTech, its directors, employees, contractors, service providers, and affiliates from claims, liabilities, damages, losses, costs, and expenses arising from your use of Serverspot, your servers or apps, your violation of these Terms, your violation of law, your infringement of third-party rights, or actions by users you invite.
12. Suspension and Termination
You may stop using Serverspot at any time and may request account deletion. We may suspend or terminate access if you violate these Terms, create risk for the platform or others, fail to pay amounts owed, engage in abuse or fraud, or if required by law.
After termination, some information may be retained as described in the Privacy Policy or as needed for legal, billing, security, backup, or enforcement purposes.
13. Privacy
Our Privacy Policy explains how we collect, use, protect, and share information. By using Serverspot, you acknowledge the data practices described there.
14. Changes to These Terms
We may update these Terms as Serverspot, our business, laws, or provider relationships change. If changes are material, we will provide reasonable notice by email, dashboard notice, or another appropriate method where required. Continued use after the effective date means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules. Courts in Nigeria will have exclusive jurisdiction over disputes arising from these Terms or Serverspot, unless mandatory consumer protection law requires another venue.
